Katelyn Kauffman-Houston, The Justice System Is Failing Her

“A protest and news conference are scheduled Thursday on the Hamilton County courthouse steps, and the protest is about Dr. Durrani victims not receiving their trials.”

Typically a gag order  which is also known as a gagging order or suppression order is a legal order by a court or government thus restricting information or comment from being made public or passed onto supposedly any unauthorized third party.

Similarly a “gag law” could be an act of limiting freedom of the press, by instituting censorship or restricting access to information.

What I cannot understand is; why should there be gag order  on the case for Katelyn Houston, named as Katelyn Kauffman-Houston in a lawsuit against the so called fugitive Dr. Atiq Durrani and the hospitals where he allegedly performed wrongful surgeries.

Subsequently after so many years of fighting, Kauffman-Houston and many more are still waiting. Seemingly Kauffman-Houston has reasons to believe that the justice system is failing her. Thusly she is not alone.

On one hand there are those who have argued that gag orders are sometimes used in an attempt to assure a fair trial by preventing prejudicial pre-trial publicity. In particular, although I no expertise in the legal arena, it seems the purpose and usage of this gag order can be argued as being controversial since it seems serve as a potentially unconstitutional prior restraint that can lead the press’s use less reliable sources such as off-the-record statements and second-or third-hand accounts to acquire information.

Similarly a west side woman has been waiting approximately nine years to confront the doctor whom she said performed an unnecessary back surgery on her is fighting to get her day in court.  She proclaimed “Our system is set up to help us, and all it’s done is fail us.”

For good reasons, Houston and hundreds of others are motivated to get a judge and jury to hear their cases against fugitive Dr. Atiq Durrani and the hospitals where he performed their surgeries. Sadly, after all these years of fighting, they are still waiting.

Meanwhile, for Houston it’s a daily fights of persistent pain, with a permanent limp and extreme nerve damages. Houston firmly believes her unrelenting pain and suffering are the direct results of medically unnecessary and improperly performed surgery, at the hands of Durrani. Her conditions are like unto continuously living in hell!

Pursuant to the gag order that was put in placed on the cases, patients have from saying much since the lawsuits were filed. Houston’s frustration(s) is understood. According to information received, she is so fed up, she is taking her chances and talking about what she can.

This question can be asked. Was the gag order given as a form of protection for the person(s) or companies or hospital(s) required to answer charges in a court?

 Subsequently, Houston was having back pain after years of playing sports. She added, on her first visit to Durrani, he told her surgery was the only option or she would suffer paralysis.

She continued to say, “When I was 21, young and naive and didn’t know any different, this guy told me I’d never be able to walk again. I was freaking terrified.”

Ironically, for Houston the surgery did not work it simply made her life far worse. Some may, it made her life a living hell!

These are the words of another victim. Katelyn’s brother Josh faces the same struggles.

Also, he said, When he was 15 years old and an aspiring collegiate baseball player Durrani performed an unnecessary back surgery on him.

Accordingly both siblings have filed lawsuits against Durrani and the hospitals where he performed their surgeries.

As the saying goes, to add insults to injury, Houston’s trial that was set for last December has been postponed and rescheduled dates has been given.

Amidst her frustrations she is speaking out. She cannot be blamed, it has been nine years since her initial surgery.

She contended, “I feel like I’ve 100% been silenced. It’s a financial, emotional, physical, and mental devastation.”

Ideally, she has contemplated for her trial to be rescheduled and for Durrani to hear her story.

She added, “I really want him to know what he did to me. Honestly Millions of dollars couldn’t pay for my health care for the rest of my life, let alone what they’ve taken from me.”

Many close to feel her pain. For her, the fight is about much more than the money but accountability and change.
